  • Consumer: a natural person acting mainly for purposes outside a business who enters into a distance contract with the company.

  • Durable medium: any means that allows the consumer or the company to store information addressed to them personally, in a way that allows future use and unchanged reproduction.
  • Right of withdrawal: the consumer's option to cancel the distance contract within the return period.
  • The company: Sofia Hartley, which offers products and/or services at a distance to consumers.

Article 3 – Applicability

These terms apply to every offer from the company and to every distance contract and order concluded between the company and the consumer.

Before the distance contract is concluded, the text of these terms is made available to the consumer. If this is not reasonably possible, it will be stated before the contract is concluded that the terms can be viewed at the company and will be sent to the consumer free of charge on request.

If the distance contract is concluded electronically, the text of these terms may, notwithstanding the previous paragraph, be made available to the consumer electronically in a way that allows it to be easily stored on a durable medium. If this is not reasonably possible, it will be stated before the contract is concluded where the terms can be read electronically and that they will be sent electronically or otherwise free of charge on request.

If specific product or service terms apply in addition to these terms, the second and third paragraphs apply accordingly, and in case of conflicting terms, the consumer can always rely on the provision most favorable to them.

If any provision of these terms is wholly or partly invalid, the contract and the remaining terms stay in force, and the invalid provision will be replaced by a provision that comes as close as possible to the purpose of the original.

Situations not covered by these terms should be assessed in the spirit of these terms. Any uncertainty about the interpretation or content of one or more provisions should be interpreted in the spirit of these terms.

Article 4 – The offer

If an offer has a limited validity period or is subject to conditions, this is stated explicitly in the offer.

The offer is not binding. The company has the right to change and adjust the offer.

The offer contains a complete and accurate description of the products and/or services offered. The description is detailed enough for the consumer to assess the offer. If the company uses images, they are a truthful representation of the products. Obvious mistakes or errors in the offer do not bind the company.

All images, specifications and details in the offer are indicative and cannot give rise to compensation or cancellation of the contract. The company cannot guarantee that the colors shown exactly match the real colors of the products.

Each offer contains enough information for the consumer to understand the rights and obligations that come with accepting the offer. This includes in particular:

  • the price in US dollars, excluding any applicable sales tax, which is calculated at checkout,
  • any shipping costs,
  • how the contract is concluded and which steps are required,
  • whether or not a right of withdrawal applies,
  • payment methods, delivery and performance of the contract,
  • the period during which the offer can be accepted or during which the company guarantees the price,
  • whether the contract is archived after it is concluded and, if so, how the consumer can access it,
  • how the consumer can check and, if needed, correct the information provided before the contract is concluded,
  • any languages other than English in which the contract can be concluded,
  • any codes of conduct the company follows and how the consumer can access them,
  • the minimum duration of the distance contract for ongoing contracts. Optional: available sizes, colors and materials.

Article 5 – The contract

Subject to the fourth paragraph, the contract is concluded at the moment the consumer accepts the offer and meets the conditions attached to it.

If the consumer has accepted the offer electronically, the company immediately confirms receipt electronically. As long as the company has not confirmed receipt, the consumer can cancel the contract.

If the contract is concluded electronically, the company takes appropriate technical and organizational measures to secure the electronic transfer of data and ensure a safe web environment. If the consumer can pay electronically, the company takes appropriate security measures.

The company may, within the limits of the law, check whether the consumer can meet their payment obligations, as well as other factors relevant to responsibly entering into the distance contract. If, based on this check, the company has good reason not to enter into the contract, it has the right to refuse an order or to attach special conditions to its performance.

Article 6 – Right of withdrawal

When buying products, the consumer can cancel the contract without giving a reason within 30 days. The return period starts the day after the consumer, or a representative appointed in advance by the consumer, has received the product.

During the return period, the consumer must handle the product and its packaging with care. The consumer may only unpack or use the product to the extent needed to decide whether to keep it. If the consumer uses the right of withdrawal, the product must be returned to the company with all included accessories and, if reasonably possible, in its original condition and packaging, following the company's reasonable and clear instructions.

If the consumer wants to use the right of withdrawal, they must notify the company within 30 days of receiving the product. Notice must be given in writing, for example by email. After notifying us, the consumer must return the product within 30 days. The consumer must be able to show that the items were returned on time, for example with a proof of shipment.

If the consumer has not given notice of withdrawal within the stated time limits, or has not returned the product, the purchase is binding.

Article 7 – Costs of using the right of withdrawal

If the consumer uses the right of withdrawal, the consumer pays the cost of returning the products.

If the consumer has paid an amount, the company will refund it as soon as possible, and no later than 14 days after the withdrawal. This requires that the product has been received by the company or that the consumer has shown that the product was returned in full.

Article 8 – Exclusions from the right of withdrawal

The company may exclude products from the right of withdrawal as described below. The exclusion only applies if the company has clearly stated it in the offer, or at least before the contract is concluded.

Exclusion from the right of withdrawal is only possible for products:

  • made to the consumer's specifications,
  • of a clearly personal nature,
  • that by their nature cannot be returned,
  • that can quickly deteriorate or expire,
  • whose price depends on fluctuations in the financial market that the company cannot influence,
  • single newspapers and magazines,
  • audio and video recordings and computer software where the consumer has broken the seal,
  • hygiene products where the consumer has broken the seal.

Exclusion from the right of withdrawal is only possible for services:

  • relating to accommodation, transport, restaurant visits or leisure activities to be performed on a specific date or during a specific period,
  • where performance has started with the consumer's express consent before the return period has ended,
  • relating to betting and lotteries.

Article 9 – The price

We reserve the right to change the prices of the products and/or services offered during the validity period stated in the offer, including in the case of changes to tax rates.

Notwithstanding the previous paragraph, the company may offer products or services with variable prices, where prices follow fluctuations in the financial market that the company cannot influence. That prices are variable and that stated prices are guide prices is mentioned in the offer.

Price increases within 3 months of the conclusion of the contract are only allowed if they result from laws or regulations.

Price increases from 3 months after the conclusion of the contract are only allowed if the company has reserved this right and they result from laws or regulations, or if the consumer has the right to cancel the contract from the day the price increase takes effect.

All prices are in US dollars. Applicable sales tax is calculated at checkout based on your shipping address.

All prices are subject to printing and typing errors. We accept no responsibility for the consequences of printing and typing errors. In the case of printing and typing errors, the company is not obliged to deliver the product at the incorrect price.

Article 10 – Conformity and warranty

The company guarantees that the products and/or services comply with the contract, the specifications stated in the offer, reasonable requirements of reliability and/or usability, and the laws and regulations in force when the contract was concluded. If agreed, the company also guarantees that the product is suitable for use other than normal use.

A warranty from the company, the manufacturer or the importer does not affect the legal rights and claims the consumer has against the company under the contract and applicable consumer protection laws.

Faulty or incorrectly delivered products must be reported to the company in writing within a reasonable time after the fault is discovered, and for visible faults preferably within 14 days of delivery. The products must be returned in their original packaging and in new condition.

The company's warranty period matches the manufacturer's warranty period. However, the company is never responsible for the final suitability of the products for the consumer's individual use, or for advice on the use of the products.

The warranty does not apply if:

  • the consumer has repaired and/or changed the delivered products themselves or through a third party,
  • the delivered products have been exposed to abnormal conditions or otherwise handled carelessly, contrary to the company's instructions and/or the instructions on the packaging,
  • the fault is wholly or partly the result of government regulations on the nature or quality of the materials.

Article 11 – Delivery and performance

The company takes the greatest possible care when receiving and fulfilling orders for products.

The place of delivery is the address the consumer has given to the company.

Taking into account what is stated in article 4 of these terms, the company fulfills accepted orders promptly, and no later than within 30 days, unless the consumer has agreed to a longer delivery time. If delivery is delayed or if an order cannot be fulfilled, or only partly, the consumer will be informed no later than 30 days after the order. In that case, the consumer has the right to cancel the contract at no cost and may be entitled to compensation.

In the case of cancellation under the previous paragraph, the company refunds the amount the consumer paid as soon as possible, and no later than 14 days after the cancellation.

If it turns out to be impossible to deliver an ordered product, the company will make an effort to offer a replacement item. At the latest on delivery, it will be clearly stated that a replacement item is being delivered. The right of withdrawal cannot be excluded for replacement items. The cost of any return shipping is paid by the company.

The risk of damage to and/or loss of products lies with the company until delivery to the consumer or to a representative appointed in advance by the consumer, unless expressly agreed otherwise.

Article 12 – Ongoing contracts: duration, cancellation and renewal

Cancellation. The consumer can at any time cancel a contract concluded for an indefinite period for the regular delivery of products or services, observing the agreed cancellation rules and a notice period of no more than one month.

The consumer can cancel a contract concluded for a fixed period for the regular delivery of products or services at the end of the fixed period, observing the agreed cancellation rules and a notice period of no more than one month.

The consumer can cancel the contracts above at any time, without being limited to a specific time or period, in at least the same way as they were concluded, and always with the same notice period that the company has reserved for itself.

Renewal. A contract concluded for a fixed period for the regular delivery of products or services may not be automatically extended or renewed for a fixed period.

Article 13 – Payment

Unless otherwise agreed, amounts owed by the consumer must be paid at the time of ordering, using the payment methods offered at checkout.

The consumer must notify the company without delay of any errors in the payment details provided.

In the case of non-payment, the company has the right, within the limits of the law, to charge reasonable costs communicated to the consumer in advance.

Article 14 – Complaints

Complaints about the performance of the contract must be submitted to the company, fully and clearly described, within a reasonable time after the consumer has discovered the problem.

Complaints submitted to the company are answered within 14 days of receipt. If a complaint requires a foreseeably longer handling time, the company will reply within 14 days with a confirmation of receipt and an indication of when the consumer can expect a more detailed answer.

If the complaint cannot be resolved by mutual agreement, a dispute arises that is subject to the dispute resolution procedure in article 15.

A complaint does not suspend the company's obligations, unless the company states otherwise in writing.

If the company finds a complaint justified, the company will, at its own choice, replace or repair the delivered products free of charge.

Article 15 – Disputes

Contracts between the company and the consumer to which these terms apply are governed by the laws of the State of Florida and applicable United States federal law. If a dispute cannot be resolved by mutual agreement, the consumer may contact their local consumer protection agency or the Federal Trade Commission (www.ftc.gov).

Article 16 – Personal information

Providing personal information through the store is covered by our privacy policy.

Article 17 – Errors, inaccuracies and omissions

Information on our website or in the service may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, prices, promotions, offers, shipping costs, delivery times and availability. We reserve the right to correct such errors, inaccuracies or omissions and to change or update information or cancel orders if any information in the service or on a related website is inaccurate, at any time and without prior notice (including after you have placed your order).

It is your responsibility to check our website regularly for changes. Continued use of the website or service after changes are posted means you accept those changes.
